By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law.

  1. Permission is granted to temporarily download one copy of the materials (information or software) on Company's web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

Company may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.

8. Governing Law

Any claim relating to Company's web site shall be governed by the laws of the State of New York without regard to its conflict of law provisions.

Online Classes and PCA Virtual Retreat

*Cancellations
  1. Due to the nature of online events, where supply lists and other proprietary information is downloadable upon purchase, online classes are non-refundable.
*Copyright
  1. I understand that the original tutorial content and projects presented on this site belong soley to the teacher who created them.
  2. You may not reproduce for sale or otherwise the contents of tutorials or projects to be sold or distributed on the internet or at in-person events.
  3. You may create your own variations of any projects you learn here for sale or for fun. Please note- it is always ethical to credit an artist as your inspiration if you are heavily influenced by their techniques. For example: “Inspired by Kira Slye’s tutorial in PCA 2017.”
*Duration of your access
  1. You will have access to PCA 2017 until September of 2018, which is one year after paid access to the course closes. This is to allow all members at least 1 full year of access.
*Downloads & Video
  1. The videos in PCA are not downloadable until the closing of the event. Upon closing, you will receive instructions on how to download videos to keep.

Live PCA Events

  1. I understand that in order to reserve my spot at a Live PCA Event, a non-refundable* deposit is required. (Applies to all events/payment plans, including payment in full.)
  2. For events that include lodging, I understand that, unless I elect to pay for a private room, I will be assigned to shared room with other guests, but that I will have my own bed.
  3. I understand that airfare or transportation to the event is not included in my tuition.
  4. I understand that if I choose an option other than payment in full today, the following will apply to me:
    1. I will be invoiced as my agreed upon payments become due until my tuition is paid in full.
    2. A non-refundable processing/finance charge of $5 will be included as part of each installment payment. There is no processing/finance charge on the initial payment/deposit.
    3. If my invoices are left unpaid for more than 10 business days after their due date, I understand that my spot may be forfeited.**
*Cancellations
  1. I understand that I will have until October 1, 2016 to cancel my Live PCA Event registration at no charge. After this date, my deposit will become non-refundable.
  2. I understand that the cancellation request must be received via email at [email protected] prior to October 1, 2016 in order to have my deposit refunded.
  3. I understand that cancellation requests received after October 1, 2016 has passed will not qualify to have the deposit refunded. No exceptions.
  4. I understand that processing/finance charges associated with payment plans as outlined above are non-refundable.
  5. I understand that after the initial refund period has passed, cancellations/refund requests are accepted on the following terms. (Please note: Refundable balance of tuition is calculated by taking the total tuition paid to date, and subtracting any non-refundable items as outlined above.)
    1. If the start date of the event registered for is more than 90 (91+) days away, I may receive 100% of the refundable balance of my tuition.
    2. If the start date of the event registered for is between ninety and thirty-two (90-32 inclusive) days away, I may receive 50% of the refundable balance of my tuition.
    3. If the start date of the event registered for is thirty-one (31) days away or less, my registration becomes 100% non-refundable.
    4. Transfer of Registration
      1. I understand that Live PCA Event registrations are transferrable between people according to the following guidelines:
        1. Registrations become non-transferrable between persons thirty-one (31) days prior to the start date of the event registered for.
        2. All transfers must be approved in writing by Ilysa Ginsburg & Kira Slye.
**Declined Payments
  1. I understand that it is my responsibility to pay installment invoices within 10 business days of their due date. Failure to do so may result in my spot being forfeited along with my deposit and any processing/finance fees paid to date. I understand that my payment plan will then be cancelled and any monies that are still refundable will be refunded. (See cancellation policy above for when funds become non-refundable.)
  2. I understand that delayed payment of any monthly installment will not affect or delay the due date of any future installments of my payment plan.

Refusal of Service

Ilki Media, Inc. does not discriminate on the basis of race, color, ethnic origin, national origin, creed, religion, political belief, sex, sexual orientation, marital status, or age. However, I understand that Ilki Media, Inc. reserves the right to refuse service and/or cancel guest registrations – at any time – at its sole discretion, including, without limitation, if Ilki Media Inc. believes that customer conduct may violate applicable laws, disrupt Ilki Media, Inc.’s normal business activities, or is harmful in any way to Ilki Media, Inc., its volunteer staff, and/or other guests.

Waiver of Liability

I hereby waive and release, indemnify, hold harmless and forever discharge Ilki Media, Inc. and its agents, employees, officers, directors, affiliates, successors and assignees, coaches, teachers and trustees of and from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages and liabilities, of every kind and nature, whether known or unknown, in law or equity, arising from or in any way relating to my participation in any of the events or activities conducted by, on the premises of, or for the benefit of Ilki Media, Inc.

I acknowledge there may be risks associated with physical activities, travel, and attendance at Live PCA Events, and that while these risks are minimal, they are nonetheless real. These include but are not limited to risks associated with food-borne illnesses or allergic reactions; walking on lawns, gravel driveways, and dirt paths; bending and reaching, sitting for long periods of time, and so on. I acknowledge that I am participating voluntarily, and that all risks have been made clear to me. Additionally, I do not have any conditions that will increase my likelihood of experiencing injuries while engaging in any of the activities associated with Live PCA Events. I further acknowledge that in the event of any accident, injury, or illness, common sense first aid assistance will be offered, and then professional medical assistance will be offered immediately from local providers in the immediate area, and that I am 100% responsible for any professional care that is required. I acknowledge that I am assuming all risk and responsibility for my personal health and safety while at Live PCA Events.

The goal of Live PCA Events is to help each guest learn polymer clay and mixed media techniques while relaxing and enjoying the company of other creative people. Anything taught or spoken at any Live PCA Events should be treated as non-professional conversation, not in any way or form as professional counsel. This program is in no way a substitute for professional treatment for any diagnosed or undiagnosed physical, mental, or emotional illness, disease, or disorder. I understand that Ilki Media, Inc. advises me to consult a professional for any of these conditions.

By registering for any Live PCA Event I forfeit all rights to bring a suit against Ilki Media, Inc. for any reason. In short, I acknowledge that I am assuming all risk and responsibility for my personal health and safety while at a Live PCA Event.

I understand that I will be required to submit a signed and dated copy of these terms and conditions prior to my arrival at the Live PCA Event I am registered for.

Trademarks

All trademarks, service marks and trade names of Ilki Media, Inc. used in the site are trademarks or registered trademarks of Ilki Media, Inc., dba CreateAlong.com, PCA, Polymer Clay Adventure, and PolymerClayAdventure.com.

Special Needs/Accomodations

At the 2017 PCA on the beach retreat 10/23/17-10/28/17, there are limited accommodations for wheelchairs and scooters. We do have an elevator. We are allowed a limited number of service animals. If you have a need for these accommodations please email us as soon as possible to discuss your options.
